General Contest Terms and Conditions
You may not be eligible to enter all Kennedy Blue contests. We do not let any child who is under the age of 13 participate in our contests. While some of our contests are open to children 13 years or older, we strongly recommend that you obtain the permission of your parents before participating. Parents are directed to read the Notice to Parents set forth below. Finally, directors, officers, and employees of Kennedy Blue, as well as their immediate families (i.e., parents, spouses, children, siblings, and grandparents) and household members are not eligible to participate. Each Submission must meet all applicable contest rules in order to be considered.
You should also note that some Kennedy Blue contests require the winner to be physically present in order to claim the prize. The published contest rules applicable to the contest you want to enter will describe the conditions you must meet to be eligible to participate. Kennedy Blue reserves the right to limit eligibility to participate in contests. Contests are void where prohibited.
Notice to Parents
Use, Ownership, and Content of Submissions
Many Kennedy Blue contests require you to submit an essay, photo, video footage or other audio-visual materials. We refer to any of these materials that you submit, regardless of format, as “Submissions.” The requirements applicable to Submissions are set forth in these Terms and Conditions and in the published contest rules. Please note that Kennedy Blue reserves the right to reject Submissions or to remove Submissions in its sole discretion. Kennedy Blue is not responsible for any incorrect, inaccurate or incomplete entry of information in or in connection with a Submission; and lost Submission; an interrupted or unavailable network, server or other connection; scrambled transmissions or other errors or problems of any kinds whether mechanical, human, or electronic, or technical malfunctions or computer hardware, software, or any combination thereof; or any problems associated with corrupt files or viruses or any damages caused thereby to your systems.
You understand that once we receive your Submission, the Submission and all intellectual property rights therein become the sole and exclusive property of Kennedy Blue and we have no obligation to return it to you. You further understand and agree that any Submission you provide to us may be used on our website, in our marketing and advertising materials, and through other media, even if the Submission is not a contest winner, and that you will not be entitled to any compensation from Kennedy Blue for such uses. Additionally, by providing us with a Submission, you agree that you own or have all necessary licenses, rights, and consents necessary to provide Kennedy Blue with the Submission for publication and display on our website and through other media. To the extent that for any reason, including by operation of law, you or any other party retain any right, title or interest in or to the Submission or any intellectual property rights therein, you grant us a transferable, royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, communicate to the public, perform and display your Submission worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed, for the full term of any rights that may exist in such Submission. You also consent to users of our website accessing, displaying, viewing, storing and reproducing the Submission for personal use.
You understand that Kennedy Blue may reject or remove any Submission that contains business solicitations, nudity, obscenity, lewdness, excessively violent, unreasonably offensive, harassing, sexually explicit or otherwise objectionable or illegal subject matter, or content that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national or international law or regulation, including intellectual property laws, or encourage the use of controlled substances, or any other content that Kennedy Blue deems objectionable in its sole discretion. However, Kennedy Blue does not intend to review Submissions for content and assumes no responsibility or liability for the contents of Submissions, and does not endorse any opinion, recommendation or advice contained in any Submission. Additionally, by providing a Submission, you agree to defend, indemnify, and hold harmless Kennedy Blue and its officers, directors, employees, and contractors from any claim, demand, loss, liability, or expense (including reasonable attorneys’ fees), relating to or arising out of your Submission, your violation of these General Contest Terms and Conditions, or any other terms, conditions, or policies relating to our website, including without limitation claims that the Submission violates the intellectual property rights of another party.
Finally, it is our policy to respond to and investigate notices of alleged copyright infringement on our website as more fully described under the heading “Notification of Copyright Infringement Under the Digital Millennium Copyright Act” at https://www.KennedyBlue.com/termsofuse.aspx. You should also understand that Kennedy Blue will cooperate fully with any law enforcement officials and/or agencies in any investigation regarding you or your Submission.
Please note that we cannot be responsible if you or your child include Personally Identifiable Information or other information that allows your identity or other information to be discerned in your Submission.
Limitations of Liability
By providing a Submission, in addition to any other limitations set forth at http://www.kennedyblue.com/pages/termsofservice, all of which are applicable hereto, you understand and agree that the following terms will govern your participation in any contest. You agree to and hereby do release Kennedy Blue and its directors, officers, employees, and agents from and against any claim or cause of action arising out of participation in the contest or the receipt or use of any prize you receive. Any claims, judgments or awards that you may receive notwithstanding the preceding sentence will be limited to actual out-of-pocket costs incurred, and in no event attorneys’ fees. You hereby waive and release all rights to claim punitive, incidental, and consequential or other special damages, and any and all rights to have damages multiplied or otherwise increased. You agree that to the extent the laws of any state prohibit, invalidate, or modify the foregoing limitations, you desire that they nonetheless be enforced to the maximum extent permitted by applicable law.
Taking Your Measurements
For the most accurate measurements, do not measure over your clothing. Your measurements should be taken while wearing undergarments similar to the ones you will wear with your dress. The measuring tape shouldn’t be pulled too tight or have too much slack, and should always be parallel with the floor.
Wedding apparel is typically sized differently than retail clothing, so keep in mind that it’s not uncommon to find yourself requiring alterations.
Wrap the tape around your back and under your arms at the fullest part of your bust (not underneath the bust).
While standing up straight, bend at the waist to one side. Take the measurement where the natural crease happens in your side. This should be a few inches above your belly button. Stand up straight and do not “suck in” when taking this measurment.
Standing with your feet together, wrap the tape around the fullest part of your hips and butt to get this measurement.
Compare these three measurements to the Kennedy Blue size chart above. It is very important that you order the largest size that corresponds to your measurements. For example, if your bust measures 40.5” (size 12), your waist measures 31” (size 10) and your hips measure 41.5” (size 8), we advise that you order a size 12, and get your dress altered down to custom fit your body.
Depending on the fabric, a dress can be altered down up to 2 full sizes, but can be very difficult to let out as there is only about .5 inch of fabric to do so at the seams.
